In case this is not reasonably possible, Githa van Eeuwen Art Studio will indicate where these Terms and Conditions can be viewed digitally before concluding the distance contract. At your request, they will also be sent to you – digitally or otherwise – as soon as possible and free of charge.

Products and services offered

If a product or service is offered for a limited time only or is subject to certain conditions, this will be explicitly stated.

The products or services offered contain a complete and accurate description. The description is sufficiently detailed to allow a proper assessment of them. If images are used, they are, as far as possible, a true reflection of the products or services. Obvious mistakes or obvious errors in the products and services offered are not binding upon Githa van Eeuwen Art Studio.

The products and services offered are subject to their availability. Githa van Eeuwen Art Studio has the right to terminate the agreement. Githa van Eeuwen Art Studio accepts no liability for typographical errors or errors resulting from the operation of the website or from the failure of web servers or mail servers.

The agreement

The agreement is concluded as soon as you have completed the ordering process on the website and the payment has been made and received.
After you have placed an order, Githa van Eeuwen Art Studio will send you a digital confirmation as soon as possible. As long as you have not received a confirmation of your order, you may cancel the agreement.

Prices

During the period of validity mentioned in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.

The prices mentioned with the products or services offered include VAT and exclude shipping costs.

In the event a product or service is listed at an incorrect price due to a technical or typographical error, Githa van Eeuwen Art Studio will not accept any liability for this. In the case of technical and typographical errors, Githa van Eeuwen Art Studio is not obliged to deliver the product at the incorrect price. If the correct price is higher than the price that was incorrectly listed, you have the right to cancel the order.

Delivery and execution

The place of delivery is the address that you have provided to Githa van Eeuwen Art Studio.

Githa van Eeuwen Art Studio will execute accepted orders as soon as possible, but at least within 30 days, unless you have agreed to a longer delivery period. If the delivery is delayed, or if the order cannot be executed or only partially, you will receive a message as soon as possible, but no later than 30 days after you placed the order. In that case, you have the right to dissolve the agreement without any costs. You are not entitled to any compensation.

All shipping times are indicative. No rights can be derived from any transit times indicated. In case a transit time is exceeded, you are not entitled to any compensation.

If it turns out to be impossible to deliver a product you have ordered, Githa van Eeuwen Art Studio will refund the amount paid by you as soon as possible, but at least within 14 days.

Githa van Eeuwen Art Studio bears the risk of damage and/or loss of the ordered products until the moment of delivery, unless explicitly agreed otherwise.

Right of withdrawal

In the event a purchased product does not meet your expectations, you may return it in its original packaging within 14 days without giving reasons. This cooling-off period starts on the day you receive the product. The costs for the return shipment are at your own expense.

Before you return a product, please contact us at studio@githavaneeuwen.com for any additional return instructions.

If the products are in their original condition, the full purchase price (excluding the return shipping costs) will be refunded to you within 14 days. Refunds will be issued back to the original payment method used by you, unless you explicitly authorise another payment method.

Please note: Products made especially for you, for example prints in a non-standard size, cannot be returned.

Regarding the provision of services, you may dissolve the agreement within 14 days without giving any reason. This cooling-off period starts on the day you enter into the agreement.

Conformity

Githa van Eeuwen Art Studio guarantees that the products and/or services offered are in accordance with the agreement and the specifications listed.

However, in the case of images there is always a difference between the display of colours on different monitors and on paper. For this reason, no rights can be derived from the appearance of products on your screen.

Payment

Unless otherwise agreed, any amounts due must be paid within 10 working days after receiving confirmation of the agreement.

If there are any inaccuracies in the payment details provided or indicated, please inform Githa van Eeuwen Art Studio immediately.

In case of non-payment, Githa van Eeuwen Art Studio has the right, subject to legal restrictions, to charge you for any reasonable costs made known to you in advance.

The products of Githa van Eeuwen Art Studio are sold for decorative use only. It is expressly not permitted to use them for other purposes or to reproduce, edit and/or distribute them in any way without the explicit prior written permission of the artist, Githa van Eeuwen, who can be contacted via studio@githavaneeuwen.com.

Final provisions

Any provisions deviating from these General Terms and Conditions will apply only if they have been agreed in writing between the parties. Any general terms and conditions used by the buyer are expressly rejected.

The legal relationship between the parties is exclusively governed by Dutch law, also if the buyer lives abroad.
